Terms & Conditions

  1. For good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged, Applicant hereby irrevocably grants Historical Military Establishment of Upper Canada (“HMEUC”), and their respective agents  and assigns, the full and complete right, but not the obligation, to use the “1812 Veteran Information” and “1812 Veteran History” (the “Property”) in any manner HMEUC sees fit in connection with the 1812 Veteran’s Web sites (the “Project”), and to use and authorize others to use the Property as so incorporated in the “Project” in the distribution, sale, licensing, marketing, advertising, promotion, exhibition and other exploitation of the Project in all markets and other uses of the Project.
  2. Applicant warrants and represents that Applicant has the right to grant all rights granted herein and  the HMEUC’s use of the material as permitted herein will not infringe on the rights of any third party. Applicant will indemnify and hold HMEUC harmless from and against any and all claims, damages, liabilities, cost and expenses arising out of any breach of the foregoing warranty. Applicant acknowledges that HMEUC will rely on this permission and hereby agrees not to assert any claim of any nature whatsoever against anyone relating to the exercise of the permission granted hereunder.
  3. Applicant understands that they are required to do the groundwork to prove their claim for 1812 Veteran Status (“Status”) and that their application may be denied Status if it is found lacking or this application is missing required information. Applicant should be prepared to provide a biography of the veteran including Regiment, Militia, Unit or Faction records, service dates, certificates of service, ie. enlistment or discharge, anything that will verify that the name provided was indeed a part of a regiment or militia. Land grant information, even mention in a dispatch or on a muster role would suffice.
  4. NOTE THAT THIS PROJECT WILL NOT PERFORM THE BACKGROUND PROOF, FACT-FINDING. IT IS THE SINGULAR RESPONSIBILITY OF THE APPLICANT TO DO THIS AND PROVIDE COPIES OF FOUND PROOF. RESOURCES WILL BE POSTED ON THE WEB SITE TO HELP FACILITATE YOUR SEARCH. DO NOT CONTACT THIS PROJECT FOR RESEARCH.
  5. It is understood that many records no longer exist for First Nations and single burial sites . It  is this Project’s mandate to honour all who served in this War and it is accepted that the First Nations played a key role. We are open to working with the First Nations as to how to approach this subject and honour those warriors.
  6. Applicants will be required to notify the press and this Project of the plaque installation ceremony date and location. The installation of the plaque must take place within six (6) weeks of approval. It is the Applicant’s responsibility to provide 4-6 still digital colour photographs of the ceremony, 6 mega-pixels or higher quality. These photographs will be considered part of the Property referred to in paragraph 1 and will be used for inclusion on the 1812 Veteran’s web site and for promotional purposes.
  7. Application will be responsible for the shipping costs of the plaque to the location recorded when they created their login account. It is the Applicants responsibility to ensure that their address and contact information remain current.
  8. This Project is only open to veterans that fought in the War of 1812 and have graves located within Canada at this time.
